I don't think it's a smokescreen at all. Formally accusing another club of tapping up - and presenting a dossier of evidence to the PL - is a very serious step to take, with lots of legal implications and potentially very serious consequences for either club. Levy would not have taken this step lightly and without all due consideration.
In any case, Spurs fans don't need convincing that Levy has done everything he can to keep Berbatov - it's pretty self-evident and Berbatov's eventual departure has long been widely expected.
I'd also repeat that it's not really about 'Fergie's comments', except of course that they clearly upset Levy. If you read his statement it's clear that his main concern is what he calls 'a series of events dating back to last summer', unauthorised contact with the player and his agent, and 'systematic' attempts to prise the player away. Fergie's alleged comments are only a recent thing and so are clearly not the substance of the tapping up charge.

It is a lot of money, but Spurs fans do expect more if the deal is with another Prem club.

Transfer market inflation has moved on hugely since the times of the bids you mention - so they are not really very relevant benchmarks IMO.
