Mikel documents forged

Former Lyn Oslo director Morgan Andersen has been found guilty of forging contracts relating to John Obi Mikel in 2005.

Andersen, who has told the court he plans to lodge an appeal, was handed a one-year suspended jail sentence for the offence.

Nigeria international Mikel, who left Lyn to join Chelsea in the summer of 2006 after a protracted transfer saga also involving Manchester United, initially joined the Norwegian club as an amateur as he was under 18.

After the midfielder's 18th birthday, the Norwegian FA were presented with a professional contract which Mikel has denied signing.

The court ruled that the falsified documents, which the judge decided had been cut from Mikel's amateur deal, meant that Lyn were able to gain a share of the player's transfer fee.

Judge Torjus Gard said in his judgement: "The court is in no doubt the contracts were amended and Andersen knew this."

Andersen is currently on leave from his post as director of Fredrikstad, another top-flight club in Norway.

Mikel performed a U-turn over a proposed move to Old Trafford, claiming he had been put under pressure to join the Red Devils.

Chelsea later reached a financial settlement to secure his services, paying £12million to their Premier League rivals and a further £4million to Lyn.

I cannot see how Chelsea would get their money back from us. The contract he signed with us was perfectly legitimate -- he just then chose to break it to go to Chelsea. The only money I can see successfully reclaiming is the £4,000,000 that they gave to Lyn.

I'm enjoying seeing the moon-faced fucker rotting on the Chelsea bench, behind Lampard, Ballack and Makalele, that's for sure.

Here's hoping they sign another CM this summer and fuck his career permanently.

Precisely. Our contract with him is fine, so Chelsea still owe us the money.

I'm sure we've already paid.

And how much did you lot buy him from Lyn for? Whatever it was it must be the best bit of business ever. 0 games, 0 training sessions, 12 million squids.

We both made £15 mil losses on that bloke. Although to be fair you did not pay his wages for about 3 years while he played for other clubs.

MU held Mikel's registration, that's what the transfer fee was paid for. That registration was transferred to United by Andersen after he forged Mikel's signature on the contract enabling himself to sell the player his club didn't own.

If United aren't happy about being duped by Andersen and Lyn they should sue them and demand their money back because Chelsea will sure as hell will want theirs.

Officially yes, But his loan at Inter (they pay all his wages) ends at the same time his Chelsea contract expires. Shame. Great player.

He signed to us. If anything, we can reclaim that 4 million that went to Lyn.

Exactly, what is so hard to understand there? Whether or not Lyn owned him prior to us signing him is irrelevant. Either we were signing a player owned by Lyn or we were signing a free agent (in which case Lyn owe us money, too). In both cases Mikel signed a legally binding contract with us, irregardless of who did or did not own him before that.

Chelsea then proceeded to poach him, and FIFA rectified that by saying that Chelsea owed us money. They had taken a player who, to all intents and purposes, was our player. He had signed the contract.

The issue here was whether Lyn owned the player previously. If they did, then they're entitled to keep the money paid to them by both United and Chelsea. If they didn't (which clearly is the case), then Mikel was effectively a free agent. But that doesn't render the contract that he signed with United null and void, because he signed a legally binding contract there.

All this represents is that Lyn were in no position to earn money out of him, which they did. The contracts he later signed with Manchester United and Chelsea will not be affected by this ruling, since they weren't related.

Do you even read the thread before posting? How can MU reclaim the £4m that Chelsea paid to Lyn? If anything that money should go back to Chelsea.

Andersen and Lyn aren't entitled to shit because they didn't own the player.

United are entitled to whatever fee they paid for Mikel's registration to Lyn.

Chelsea are entitled to £12m from MU and £4m from Lyn since the deals between the clubs in Mikel saga should be voided on the grounds that the original sale was conducted through fraud.

Mikel should become a free agent and sign with the club of his choosing.

You were in a position to sign him to the contract because you acquired his registration from Lyn. If they didn't own the player they had no right to sell him to you and your contract is worth big fat fucking zero.

That's wrong. He signed a contract with us. Whether he was previously owned by Lyn or not is irrelevant. He signed a contract with us. Sure, Lyn gave us permission to do so, but in actuality we could have done so without their permission since it turns out that he wasn't owned by Lyn.

Consider it this way:
Lyn own the contract -- we get in touch with them, they transfer his registration to us and Mikel signs a contract to join us.
Lyn do not own the contact (as is the case) -- Mikel owns his own registration, and signs a contract to join us. By doing so he is transferring his registration to us.

In both cases we receive his registration regardless of who held it before (Lyn or Mikel).

This proves that rather than being owned by Lyn, he was a free agent. That doesn't change that he signed a contract with us. It wasn't his contract with us that was counterfeit -- that was perfectly legal. The fraudulent contract was the one that said he was owned by Lyn, and thus they have no right to receive any transfer funds.

Anyway, I'll say no more on this. It's a simple concept, and that you refuse to grasp it shows how desperate you are to get "one up" on United. I'm right, and Chelsea will not get that money back from United.

OK genius, explain to me this. If Lyn, as you correctly pointed out, didn't own the player, then what did you pay the transfer fee for?

MU acquired the rights to the player through fraud, whether they knew about it or not at the time, is irrelevant, it's still illegal in the eyes of the law.

Here's another interesting fact: where was Mikel's representation?
The player's agent wasn't informed, was deliberately kept away and wasn't present at the signing so that Andersen could manipulate an 18 year old kid using forged documents. His own family only found out about what had happened after United deal was announced. MU representatives probably didn't know all the details but they jump at the chance to buy the much coveted youngster from under their rivals noses. In the end,it didn't exactly work out like they expected but that happens from time to time when you deal with shady characters, like Andersen or Shittu.

If you still think that United are in the clear and shouldn't return the compensation you're just too biased to see the obvious.

More details. Doesn't say anything about the 12m, but some interesting stuff about how young African players eventually end up at big European clubs.
Quote:
The tricky case of John Obi Mikel
* Mihir Bose - BBC sports editor

Morgan Andersen, former director of the Norwegian club Lyn, has been convicted of forging a contract with John Obi Mikel, the player who became embroiled in a transfer row between Manchester United and Chelsea.

The court case in Norway may have no bearing on Mikel’s status as a Premier League player, and did not concern either Manchester United or Chelsea, but it shines a light on the often mysterious and dark ways in which young African players end up in Europe.

The case has always generated great interest in Norway as well as bemusement as to why there is little interest in England in a matter involving a Premier League player whose moves first to Manchester United and then Chelsea sparked great controversy and no little amount of transfer fees.

In Norway, the case was diligently pursued by the police and the prosecutors and led to such interest that when the trial began, Anderson's supporters gathered outside the courthouse in Oslo proclaiming his innocence.

The case produced some fascinating testimony as to how young African players are recruited.

This included testimony by Rune Hauge, the well-known Norwegian agent, who claimed Chelsea were behind the placing of four young Nigerians - including Mikel - in Norway waiting for them to reach 18-years-of-age.

He also said Chelsea paid for everything. The court also heard testimony that Chelsea had violated Fifa regulations. The Norwegian prosecutor, Sven Holden, was concerned with Mikel’s first professional contract with Lyn. In court, Holden read out a statement Mikel had given the Norwegian police. Mikel said he had signed two contracts before he turned 18.

The first was with Andersen and Mikel's Nigerian manager John Shittu. However, according to Mikel, Andersen told him the contract was not valid because Shittu wasn't his legal guardian.

Mikel then signed a new contract with Andersen and his father. Both contracts were for one year.

Mikel has also said he always believed he would play for Chelsea and would only stay in Norway until he was 18. But then he said he was told by Chelsea to carry on living in the country a bit longer to get better acquainted with the Norwegian league.

During this period he signed no new contracts but he was pressured by Andersen to accept an offer from Manchester United. He was worried Andersen might halve his pay and prevent him from playing.

The prosecution case was that Andersen used the signatures on the amateur contract to forge Mikel's professional contract, essential for the deal with Manchester United.

Holden told the court that Andersen falsified the contract, enabling him to sell Mikel to Manchester Untied and profit from the deal. Had there been no contract, Holden claimed "Lyn would have been left with crumbs when Mikel disappeared out of the club".

Holden added: "I'm convinced that there was no contract between Lyn and Mikel. At the same time I'm convinced that Morgan Andersen falsified the contracts and that the court should convict him.”

Mikel was eventually transferred to Chelsea which saw the London club play Manchester United £12m and Lyn a further £4m.

Andersen, who vigorously protested his innocence in court, cl
