Yes I'm aware, I have been on gardening leave myself and put people on gardening leave, I'm talking about the one-upmanship of journalism for something that is a standard practice.

I'm not talking about his laptop being block, I agree that is a standard process but reporting on it and putting it in capitals.

Actually what is childish is youtubers and twitter accounts talking about how we should recruit him because he has huge database of analysis and that database would be priceless for us

That database, which probably does exist, is intellectual property of Newcastle! It was created, by Ashworth and his team, while employed by Newcastle. In no scenario can he take that with him or use it. Anybody who has been employed anywhere where any intellectual property is generated knows it

We are not getting any database with Ashworth, whether Newcastle blocks his access or not. And blocking his access would also be fairly normal and standard under circumstances

Not really. Being placed on garden leave is very much that — you’re in the “garden” and all access to work and confidential information is basically taken away from you.

In exchange, you carry on getting paid to sit there.

Two parties agree a contract of a certain length. If either party terminates that contract early, they are liable to pay compensation to the other party for their loss of earnings and/or use of their service for the contracted period. By placing Ashworth on gardening leave, they are saying his job is now untenable due to his demand to leave. Newcastle United absolutely can keep him on gardening leave for the remainder of his contract. He’s under contract. He wants to break that contract. Newcastle want to be compensated for him breaking that contract, in the same way he’d want to be compensated if Newcastle replaced him.

What will happen is the lawyers will thrash this out in the coming months and a settlement figure will be reached.

They also believe it is worth waiting a few months for the ideal candidate, who represents a long-term change of direction.

Talks with Ashworth were led by board member Jean-Claude Blanc, although it is in line with plans from new chief executive Omar Berrada, recruited from Manchester City.


Sir Dave Brailsford had wanted former Liverpool executive Julian Ward for the rule, but Ashworth has long been the overall favourite.

This’ll get done at 10m surely with some gardening leave still in place (maybe 6 months to get Newcastle through the summer).

Also I asked earlier in the thread but is it possible that Ineos hire Ashworth so the fee comes from their coffers and not Utd?

I'm more talking about the journalist rather than than Newcastle. I think this has all come from Henry Winter saying about the database on his laptop, if he hadn't have said that then it wouldn't have been mentioned.

Every club will have a massive database and scout reports and it more about the choices and strategy. We have one but continually make poor choices or haven't created an environment for them to succeed.

I can understand Newcastle being worried about us nicking all their summer targets, but putting him on gardening leave will hardly stop him from saying who they're going for.

Like others have said this feels like a really easy thing for the club to circumvent. Don't pay them 20m. Offer them 10 as a gesture of good will and call it a day.

Gardening leave is very common in all the walks I've life I've had the joy of living, however I am curious if it's like that in back office football positions. This quite 'new' at least in two ways:
1. The sheer scale of the 'demand'
2. That NUFC are clearly leaking all they can to anyone will listen

I particularly loved the ones last week of how Eddie is really worried about him using his knowledge to help United. Literally what he's being paid for, and why you paid for him from Brighton.

Feels to me like someone at NUFC just really hates us. Which is fair given the fates of the two clubs. I still have to laugh at the Longstaff price. Magic.

To be honest it feels like something Eddie would rather talk about than his league position.

It's quite normal to have contracts that stipulate you can't work for a competitor within e.g. six months of leaving your position in all sorts of sectors, so it's no surprise it's the same in football. It's basically so you can't have someone getting the inside knowledge of new research etc. and then immediately "selling" that knowledge to someone else.

However, nothing is preventing me from resigning. This seems like some sort of deal negotiated when Dan signed. I mean, what's preventing him from discussing stuff with United, even while on gardening leave? He could simply talk to them. It all sounds bizarre.

Is blocking an employee from moving job even legal? Obviously football is different but I couldn't imagine an employer in a solicitor office or accountants office being allowed to stop and employee leaving

But United could have had numerous Sporting Directors. There are very good ones currently without a club who'd sign today and start tomorrow.

They've specifically gone for Ashworth despite the difficulties because they believe he is the one who will help make Manchester United title challengers again. They knew going in how difficult it would be and if they believe he is that valuable then I personally accept them forking out £20m from the summers transfer kitty to make it happen. Beats constantly paying millions for the Glazers to buy their dogs prams.

This will get sorted before the summer. It's not in Newcastle's interests to gain a reputation for making it hard for senior employees to leave. It'll make it harder for them to attract that caliber of employee moving forward.

We make his job twice as difficult if we cave into the demands of the first club we negotiate with in the INEOS era.

He's not prevented from resigning, he's just prevented from taking up work with a competitor until a certain amount of time has passed. He can obviously discuss stuff with United, but he might be in legal trouble if someone can prove what he discussed with United could be classified as "work". Although I know nothing of what that might mean within the UK legal system.

All of the noise is for show. They might be annoyed with Ashworth, they did the same when they brought him from Brighton so I don’t see why they should be, but they will let him go for £8-12M. They gain nothing from having him on garden leave and not working for them - might as well get a decent fee to help with FFP.

It's called a non-compete clause. It's usually to do with trade secrets etc. Although people like Elon Musk has it in the contracts of car mechanics, which I suspect wouldn't be legal if tried in a court.
