Yes he did win the ball with his leading leg BUT he made damn sure his trailing leg hit Ben Arfa and with quite some force.
This is the key.It's the big difference between what would have been an unfortunate accident and a very intended dangerous tackle.
That was no accident, it's so blatant he wanted to leave a mark on HBA.

There are several issues with Marseille bringing an action here.

First to establish fault they'd have to establish that what happened was so reckless and so far out of the bounds of what can be reasonably expected in the sport that it amounted to essentially criminal force. While what De Jong did was certainly a disgrace I don't think it was to that extent.

Second they'd have to show loss, which at this point is not possible. Marseille haven't lost anything yet so bringing an action right now is rash. If for example he was forced to retire (like our own Collet) then ostensibly OM could bring an action for lost transfer fee, as well as the player himself bringing an action for loss of earnings, but at this stage none of that loss has been suffered.
