Both of your examples break FCC rules around obscenity. These rules are rooted in US law that says obsecene material isn't protected speech so that's why the broadcaster would be penalized.

Mr. Pillow's opinion piece made on paid airtime doesn't violate those rules and therefore is protected speech under the first amendment. OANs disclaimer is an attempt to avoid legal liability for airing the content.

The bulk of the disclaimer ("hey it's not what we believe and he's paid for this airtime") along with the first amendment would probably offer them a good amount of liability protection but the parts that go on to claim "viewers need to know this because maybe it's true" take away from that for me.

What's even more strange is that they are preaching to the choir so there's no real need to go there. Their lawyers must've thought it was fine and would offer more protection under FCC rules.

All kidding aside, I get it. My example was a bad one because it does violate obscenity statues. Plus, cable TV operates under different guidelines than broadcast TV. I still don’t get how a statement (let’s forget the last 2 lines) at the beginning of a program, one that might be missed by a majority of the audience, absolves the network of any blame. They KNOW the content of the piece, and they KNOW it is false and defamatory, and they have not only decided to air it, but have taken money to do so.

So back to my example. If NBC aired an "opinion" piece from someone who wanted to prove that the source of all STD's was Ron Jeremey, (which is far more likely than any of Pillow Biters theories), and showed movie clips as proof, would they be protected? I know it is absurd, but I just don't see how claiming in the beginning that "this is lies" can protect you. What if someone starts watching in minute 2? They miss the disclaimer. I would get it if OAN had to flash "Bullshit" on the screen every 5 seconds, but a quick disclaimer at the beginning seems flimsy at best, even without the last 2 lines.
They're bending the rules. No rules can be airtight if the intention is to break it.

In normal times that should be sufficient. But trumpites are extraordinary cases.

Seeing the thread title, and hearing Republicans urging Democrats to move on from the insurrection, I can't help of think of the aftermath of the original Civil War, where in the interest of "national unity", the North gave up on Reconstruction, left the still rebellious South to its own devices, and condemned African Americans to 80 plus years of segregation and domestic terrorism.

There is promise of a Biden led Justice Department being more heavy handed on domestic terrorists but let's wait hope and see.

Tell you truth if the South wanted to leave that would be fine with me. Put all the right wing states in one place and all the nut jobs could migrate there. Let them feck each other up while the rest of the country moves forward.

Most of the states in the south with large metropolitan areas are slowly drifting to the Dems, so what would be the advantage of succeeding ?

Obviously it wouldn’t work with demographics. I was more or less thinking of people with mindset moving to a place away from from the rest of us

That's probably as realistic as Republicans wishing California would succeed. The trick is to win on ideas across the country and have that be expressed by voters at the polls.

My neighbor moved to Penn to get away from NJ because she deemed us too liberal. More need to follow suit.

Yeah it certainly seems that way, even the huge delays in getting the national guard called in.

I have total respect for the police that were on duty that day, literally putting their lives on the line with limited gear whilst they were besieged by people wielding and firing all kinds of things. It’s a miracle more weren’t killed.

I hadn’t realised the scope until i read that article, it was like the Alamo
